Terms and Conditions of Use

1. General information
Italish (stayitalish.com) is a search and presentation portal for independent Italian accommodation facilities, operated by:

Use of the site implies full acceptance of these Terms and Conditions.
2. Description of the service
Italish offers a free basic tier for all Italian accommodation providers and an optional paid service described in section 7. The basic tier includes:
- A free platform for creating and publishing promotional pages for Italian accommodation providers
- Automatic translation of content into seven European languages through machine translation services and artificial intelligence (see section 5.3)
- An availability enquiry system between guests and accommodation providers, based on direct communication via email
- A native review system moderated by Italish and display of Google reviews when available (see section 6)
- Editorial content (blog, guides) on Italian destinations, some generated or assisted by artificial intelligence (see section 5.3)
Italish is not a travel agency, does not manage confirmed bookings with payment and is not responsible for contracts entered into between guests and accommodation providers.
3. Registration of accommodation facilities
3.1 Requirements
Accommodation facilities located in Italy that hold the necessary authorisations for carrying out accommodation activities as required by current legislation may register.
3.2 Responsibility for content
The registered facility is solely responsible for:
- Truthfulness and accuracy of the information provided (descriptions, indicative prices, services, photographs)
- Ownership or licence to use uploaded images
- Compliance of content with current legislation
- Timely updating of information
Italish reserves the right to remove false, misleading, inappropriate content or content that infringes third-party rights, without prior notice.
3.3 Approval
Registered facilities are subject to verification before publication. Italish reserves the right to refuse or remove any facility at its discretion, without any obligation to provide reasons.
3.4 Account deletion
The facility may request deletion of its account at any time by writing to info@italish.it. Data will be deleted within the timeframes set out in the Privacy Policy.
3.5 National Identification Code (CIN)
D.L. 145/2023, converted into L. 191/2023, introduced the National Identification Code (CIN) for Italian accommodation facilities and short-term tourist lettings, managed by the Ministry of Tourism through the Accommodation Facilities Database.
Italish provides the facility with a dedicated field to declare its CIN. Responsibility for possession of the CIN, its validity and updating of the information remains solely with the facility. Italish does not verify the CIN with the government portal and is not liable for the consequences arising from the publication of a facility without a CIN, where required by law.
4. Use by guests
Guests may use Italish to:
- Search for accommodation facilities by region, type and features
- Send availability enquiries to facilities via the contact form
- Leave reviews for facilities at which they have actually stayed (see section 6)
The contact form is a direct communication tool between guest and facility. Italish is not party to the contractual relationship arising therefrom. Prices, availability, cancellation terms and payment methods are determined exclusively by the accommodation facility.
5. Intellectual property
5.1 Italish Content
The design, code, editorial texts, logo and original content of Italish are the property of Punto Nero Studio di Carlo Simone and protected by copyright laws. Reproduction without written authorisation is prohibited.
5.2 Property Content
Properties retain ownership of uploaded content (texts, photographs) and grant Italish a non-exclusive, royalty-free, worldwide licence to publish, translate (including through machine translation and artificial intelligence services, see section 5.3) and distribute such content on the Italish portal and social media channels.
5.3 AI-Generated or AI-Assisted Content
Italish uses machine translation and artificial intelligence technologies for the following purposes:
- Translation of property descriptions into the six non-Italian languages (DeepL and, in certain cases, Anthropic Claude)
- Translation and cultural adaptation of editorial blog articles (Anthropic Claude)
- Assisted generation of editorial articles based on topics curated by the editorial team (Anthropic Claude), always reviewed by a human editor before publication
Translations and AI-assisted content may contain errors, inaccuracies or cultural adaptations that differ from the original version. In the event of any discrepancy, the Italian version shall always prevail. Italish is responsible for published content, including content generated or translated by AI.
Italish's automated translations are the property of Italish. Properties may use them freely in the course of their own business activities.
6. Reviews and moderation
6.1 Native Reviews
Guests may leave reviews for Italian properties listed on the portal. Italish collects reviews via a public form requesting name, email address (not published, used solely for anti-spam verification), rating from one to five, title and text. The author's email address is not published under any circumstances.
6.2 Verification of Stay
Italish does not verify by automated means the actual stay of the author at the reviewed property. By submitting a review, the author declares that they have been a guest of the property. Italish reserves the right to remove reviews proven to be false or inauthentic.
6.3 Moderation
All native reviews are subject to moderation by Italish prior to publication. Italish reserves the right not to publish, or to remove even after publication, reviews which:
- Contain offensive, discriminatory, defamatory or violent language
- Refer to matters unrelated to the accommodation experience
- Contain personal data of third parties, commercial references to competing properties or promotional links
- Are manifestly false or inauthentic
Approved reviews are ordered chronologically, from the most recent to the oldest. Italish does not use ranking algorithms that favour properties on the basis of payments or commercial agreements.
6.4 Right of Reply of the Property
The reviewed property may not obtain removal of a negative review solely on the grounds that it considers the assessment unfavourable. Requests for removal that do not fall within the moderation cases provided for in section 6.3 shall be rejected. The property may, however, report to Italish the alleged inauthenticity or falsity of a review, providing supporting evidence.
6.5 Google Reviews
On the page of certain properties, reviews from Google Maps are also displayed, obtained via the official Google Places API. Such reviews are the property of Google and their authors; Italish does not moderate them nor may it intervene in their content. The property concerned may contact Google directly for any matter relating to a Google review.
7. Italish Custom Website (paid service)
7.1 Description
Italish Custom Site is an optional paid service that enables the property to obtain an independent website (one-page mini-CMS) served on a custom domain chosen by the property, whilst maintaining in parallel the free public page on the Italish portal. The service includes the site editor, hosting, SSL certificate and any basic technical support.
7.2 Price and payment method
The price of the service is indicated on the page stayitalish.com/host/sito at the time of purchase. The property may choose between a monthly or annual plan. Payment is made through the Stripe platform, which independently manages credit card data; Italish does not store payment data.
7.3 Right of withdrawal
Pursuant to D.lgs. 21/2014 (which transposes Directive 2011/83/EU on consumer rights and amends the Consumer Code D.lgs. 206/2005), the consumer user has the right to withdraw from the contract within fourteen days from the date of purchase, without having to provide any reason. The right of withdrawal is exercised by writing to info@italish.it. In the event of withdrawal exercised within the time limit, Italish shall refund the entire amount paid within fourteen days of receipt of the communication.
The right of withdrawal does not apply to properties that purchase the service in the context of their business or professional activity (business users, not consumers). Such users remain nonetheless covered by the refund clauses set out in point 7.5.
7.4 Automatic renewal
Monthly and annual subscriptions renew automatically upon expiry, unless cancelled. Cancellation may be effected at any time from the host dashboard or by writing to info@italish.it; in such case the service remains active until the end of the period already paid for, after which it is suspended without further charge.
7.5 Suspension and refunds
In the event of non-renewal, the custom site is suspended within seven days of expiry. The free public page on the Italish portal remains active in any event, regardless of the status of the paid subscription.
Any refunds outside the right of withdrawal (point 7.3) are granted at the discretion of Italish, on a case-by-case assessment and depending on the reason for the request. Italish does not guarantee refunds for service disruptions caused by third parties (Stripe, domain provider, hosting, certificate authority).
7.6 Custom domain
The custom domain under which the custom site is served is purchased directly by the property from a registrar of its choice, in the name of the property itself or its legal representative. Italish offers DNS configuration support but is not a registrar and is not registered as the domain holder.
In the event of problems with the registrar (expiry, suspension, transfer, disputes), the property must contact the registrar directly. Italish is not liable for the accessibility of the custom domain when this depends on factors external to its own service.
8. Limitation of liability
Italish is not responsible for:
- The accuracy of content entered by establishments and guests
- The quality of services offered by registered establishments
- Damage arising from the use of information present on the portal
- Service interruptions due to maintenance, technical failures or force majeure
- Content of external sites accessible via links present on Italish
- Errors, inaccuracies or omissions in content generated or translated through artificial intelligence and automatic translation services (see section 5.3)
- Service failures of third-party providers that contribute to the operation of Italish, including Supabase (database hosting), Vercel (application hosting), Brevo (transactional emails), DeepL (translations), Anthropic (Claude AI), Google (Maps, Places, OAuth), Meta (Facebook OAuth), Stripe (payments), Mapbox (maps), custom domain provider
- Payment issues (chargebacks, card disputes, failed recurring charges) handled by Stripe in the context of the paid service referred to in section 7
- Accessibility of the custom domain referred to in section 7.6 when this depends on the registrar or DNS configuration
The service is provided "as is" without guarantees of continuity or absence of errors.
```9. Prohibited conduct
It is prohibited to use Italish for:
- Entering false or misleading information
- Publishing illegal, offensive, discriminatory content or content that violates third-party rights
- Leaving inauthentic, biased reviews or reviews relating to establishments where the author has never stayed
- Attempting to gain unauthorised access to systems or data
- Carrying out automatic scraping of content without authorisation
- Sending spam communications via the contact form
10. Changes to the service
Italish reserves the right to modify, suspend or discontinue the service at any time, even without prior notice. In the event of substantial changes to the terms of service, registered users shall be informed by email with at least thirty days' notice.
Should Italish decide to discontinue the paid Italish Custom Site service (section 7), users with an active subscription shall be entitled to a pro-rata refund of the remaining portion of the period already paid, calculated from the day of actual discontinuation until the natural expiry of the plan.
```11. Applicable law and jurisdiction
These Terms are governed by Italian law. For any dispute relating to the use of Italish, the Court of Pesaro shall have jurisdiction, subject to any mandatory legal provisions for the protection of consumers.
